The "Your Choice" Sweepstakes on Nick.com 1. NO PURCHASE NECESSARY TO ENTER OR WIN. Void in Puerto Rico and where prohibited or restricted by law. Sweepstakes is open to legal residents of the continental United States between the ages 5 and 17 at time of entry. Sweepstakes not open to employees and their immediate families of MTV Networks, Nickelodeon Online, their parent, subsidiary and affiliated companies, licensees, the advertising and promotional agencies, and any other sponsors (collectively "Sponsors") and General Mills. All entries become the property of Sponsors and will not be acknowledged or returned except as herein indicated. 2. TO ENTER: The Sweepstakes will be posted on nick.com starting on or about 12pm EST March 4, 2005 and ending on or about 12pm EST on April 4, 2005. Entrants must fill out all required fields on the Sweepstakes entry form available at http://www.nick.com and submit the entry electronically to http://www.nick.com. Entries that have been tampered with, altered, incomplete or inaccurate shall be considered void. By submitting an entry form, entrant is agreeing to be notified by e-mail if he/she is chosen as a Potential Winner in the Sweepstakes. : 3. OPT OUT: The parent and/or legal guardian of each entrant under the age of 13 will be sent a notification e-mail upon electronic submission of the online entry form confirming entry into the sweepstakes and providing the option to withdraw entry. If the option to withdraw is not exercised within the time period indicated on such notice the entry will be deemed submitted. 4. By entering, entrant acknowledges compliance with these official rules including all eligibility requirements. Sponsors and General Mills are not responsible for (i) late, lost, misdirected, incomplete, undeliverable, destroyed entries; (ii) system errors or failures, (iii) faulty transmissions or other telecommunications malfunctions, (iv) any hardware or software failures of any kind, (v) lost, non-accessible or unavailable satellite/network/web site/ISP/Usernet connections, (vi) failed, incomplete or garbled computer, cable or telephone transmissions, and/or (vii) any problems or technical malfunctions of any telephone or cable, network or lines, computer problems or traffic congestion at the ISP, on the Internet, or at a Website, or combination of any of the foregoing. Further, no responsibility is assumed for any injury or damage to entrant’s or any other person’s computer related to or resulting from entering the Sweepstakes or downloading any material for the Sweepstakes, or for other telecommunications or cable malfunctions which may limit or bar an entrant’s ability to participate. Sponsor and General Mills are not responsible for incorrect or inaccurate information caused by hacking, tampering or unauthorized third party intervention. Sponsors may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsors’ representatives. If for any reason this Sweepstakes is not capable of running as planned, including but not limited to, by reason of infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, or any other causes beyond the control of Sponsors which, in the sole opinion of Sponsors, corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsors reserve the right at its sole discretion to cancel, terminate, modify or suspend this Sweepstakes, and select winners from Internet entries received prior to the action taken. Should the Sweepstakes be terminated or cancelled prior to the stated expiration date, notice will be posted on the website, and any entries received prior to the termination or cancellation will be included in the drawing. Collection of personally identifiable information will be in accordance with the Nickelodeon Online Privacy Policy as posted on www.nick.com. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MTVN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. 5. Sweepstakes commences at approximately 12:01 p.m. on March 4, 2005 and ends at approximately 12:01 p.m. on April 4, 2005 (the "Promotional Period"). 6. Potential Winner Selection: Ten (10) potential grand prize winners (each a "Potential Winner") will be selected in a random drawing on or about April 11, 2005 from all eligible entries received. An independent judging organization will be used to choose the Potential Winners. Limit one (1) prize per household/individual. Odds of winning will depend on the total number of eligible entries received. Potential Winners will be notified by e-mail on or about April 15, 2005. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email address used to enter the Sweepstakes at the actual time of entry will be deemed to be the entrant and must comply with these rules. An authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses and the domain associated with the submitted email address. 7. The Potential Winners will be notified by e-mail pending prior approval from the parents or legal guardian as indicated above. To be considered a Winner, Potential Winner’s parent or legal guardian will be sent Proof Of Eligibility and Tax Compliance and Fulfillment/Approval sheets by e-mail to fill out online and submit to a fulfillment house within five (5) business days. If Potential Winner fails to respond within five (5) business days of being notified, Potential Winner will be disqualified and an alternate Potential Winner will be chosen from the remaining eligible entries. In addition, the parent or legal guardian of Winners must sign an affidavit (i) releasing Sponsors and their advertising and promotional agencies from any liability, claims, demands, and causes of action from personal injury and/or damage, theft, or loss suffered in connection with this Sweepstakes or the use or acceptance of the prizes or any portion thereof to be eligible; and (ii) where permitted by law, granting Sponsors the right to use his/her name, voice, and likeness for advertising and publicity purposes without additional compensation. Entry into Sweepstakes constitutes Winner’s parent or legal guardian’s agreement to sign such releases and any other legal documents that Sponsors may require (including W-9). Receipt of any of the prize components of this Sweepstakes is conditioned upon compliance with any and all applicable federal, state and local laws, rules, and regulations. Noncompliance will result in disqualification of winner. 8. The prizing is as follows: Total estimated retail value of all Sweepstakes Prizing is $500.00. 9. All prizing is non-transferable and has no cash equivalent. Merchandise cannot be returned for cash. Substitution of prize by winner is prohibited. Sponsors reserve the right in its sole discretion to substitute any prize with a prize of comparable value. In the event that a Winner chooses not to accept his/her prize, or is unable to be notified, an alternate winner will be randomly selected from all of the remaining entries. Winners are solely responsible for any and all insurance, registration, applicable federal, state, and local taxes, and any other fees and expenses related to this Sweepstakes and/or the prizes. 10. By participating in this Sweepstakes, entrants agree to be bound by these rules and the decisions of the Sponsors, which are final in all matters relating to this Sweepstakes. 11. All interpretations of the rules and decisions by Sponsors are final. Sponsors reserve the right at their sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the game or website; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. 12.
