(the “Sweepstakes”)

PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES OPEN ONLY TO LEGAL AND CURRENT
RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA WHO ARE AT LEAST
6 AND NO MORE THAN 14 YEARS OF AGE AT TIME OF ENTRY.
VOID IN PUERTO RICO AND WHERE PROHIBITED OR RESTRICTED BY LAW. If you are considered a minor in the state in
which you reside (“Minor”),
you must have your parent or legal guardian’s permission prior to
participation. Many will enter, few will
win.
HOW
TO ENTER: Visit www.Didj.com and
complete and submit an Official Registration Form as directed on the website. Normal Internet access and usage charges
imposed by your on-line service may apply.
Completed entry form (individually an “Entry”, collectively the “Entries”) must be submitted in accordance with the online
directions during the Sweepstakes Period (as defined below). Any incomplete Entry will be
disqualified. Entries must be received
no later than 11:59 p.m. Eastern Standard Time (“EST”) on December 31, 2008. MTV
Networks (the “Sponsors”) or The National Sweepstakes Company
(the “Sweepstakes Administrator”)
will not acknowledge or verify receipt of Entries except as indicated
herein. Sponsors and Sweepstakes
Administrator shall collectively be referred to herein as “Sweepstakes Entities”.
Use of a profane username or the submission of
false or misleading personal information by a Participant (as defined below)
will be grounds for disqualification.
Sweepstakes Entities retain sole discretion to determine whether Entry
information is profane, false, or misleading.
All Entries submitted become the sole property of Sponsors and
will not be acknowledged or returned.
Entries limited to one (1) entry per calendar day, per person and per
email address.
SWEEPSTAKES PERIOD:
The Sweepstakes will begin at 12:00 a.m. EST on 9/3/08 and end at 11:59 p.m. EST on 12/31/08 (the “Sweepstakes Period”). Each day
will run from 12:00 am EST to 11:59:59 pm EST and all entries must be submitted
during this time in order to be included for that day’s drawing. All those
Entries not selected on any one day will be discarded following the selection
and acceptance of the daily prize by the winner. A “day” is defined by EST, and Sweepstakes
Administrator’s clock is the official basis for determining time in the
Sweepstakes.
ELIGIBILITY: To participate in the
Sweepstakes you must be (i) a legal and current resident of the 50 United
States or the District of Columbia, and (ii) at least 6 and no more than 14
years of age (if a Minor parental or legal guardian’s permission is required)
at the time of entry (“Participant”).
The Sweepstakes and any web site pages and advertisements relating
thereto are intended for viewing only within the United States. Sweepstakes is not open to employees,
officers and directors of Sweepstakes Entities, and their respective parents,
affiliates, subsidiaries and advertising and promotion agencies and their
immediate families (parents, children, siblings and spouse, regardless of where
they live), and members of their households (whether related or not) (the “Released Parties”), and those
winners who have won a grand prize in any Nickelodeon sweepstakes/promotion in
the twelve (12) months prior to the start of the Sweepstakes Period.
GENERAL REQUIREMENTS FOR ENTRIES:
Each
Participant (and his/her parent or legal guardian) warrants and represents, and agrees to do so in writing, that
Sweepstakes Entities’ use of the materials submitted by Participant in this
Sweepstakes will not violate the rights of any third party. Entries must be in keeping with Sweepstakes Entities’ positive image, as determined by Sweepstakes Entities in their sole discretion. Any materials containing obscenities, crude
language, or descriptions of a violent or sexual nature or that are otherwise
inappropriate (as determined solely by the Sweepstakes Entities) will not be
accepted and the associated Entry will be disqualified.
DRAWING AND NOTIFICATION:
Each day during the Sweepstakes Period (beginning
on September 4, 2008) the Sweepstakes Administrator will select one (1)
potential daily prize winner (“Potential
Daily Prize Winner”) by conducting a random drawing from all Entries
received during the previous day.
Sweepstakes Administrator will notify Potential Daily Prize Winners via
email within five (5) days of each drawing. If a Potential Winner (or his/her
parent or legal guardian) fails to respond within two (2) business days from
the first notification attempt, that Potential Winner will be disqualified and
an alternate Potential Winner will be selected at random from among all the
remaining eligible entries.
Odds
of winning a prize depends on the total number of eligible Entries received
during each daily period. Sweepstakes
Entities’ decisions are final and binding in all respects. MANY WILL ENTER, FEW (ONLY ONE PER DAY) WILL
WIN.
PRIZING: Each daily winner will be awarded a
LeapFrog Didj Custom Gaming System and a Didj Custom Learning Nicktoons Game
with an approximate retail value of $119.98.
GENERAL PRIZE CONDITIONS/RESTRICTIONS: Sweepstakes
Entities are not responsible for any mechanical difficulties or failures
connected with the Sweepstakes. No transfer or substitution of Prize is allowed except at the sole
discretion of the Sweepstakes Entities.
Sweepstakes Entities reserve the right in their sole and absolute
discretion, to substitute a prize with a prize of equal or greater value. Official Winner (or his/her parent or
legal guardian) is responsible for any and all applicable federal, state and
local taxes, as well as any other costs and expenses associated with acceptance
of the Prize. Prize is awarded “as is”
with no warranty, either expressed or implied.
All prize details are at Sweepstakes Entities’ sole discretion.
RELEASES/TAXES: Before a Potential Daily Prize Winner will be deemed an Official Prize Winner, his/her parent or legal guardian will be required to
execute and return an Affidavit of Eligibility, a Liability Release and a
Publicity Release (except where prohibited) (the “Affidavit/Release”). Except where prohibited by law, Winner’s
acceptance of a Prize constitutes Winner’s permission for the Sweepstakes Entities
and those acting under their authority to use the Winner’s name, photograph,
likeness, statements, biographical information, voice, and address (city and
state only) on a worldwide basis, and in all forms of media, in perpetuity and
for advertising or promotional purposes without review, notification or further
compensation to the Winner. The
Affidavit/Release must be returned within 2 business days of Sweepstakes
Entities sending such documents. If the
documents are not returned within that time, the Potential Daily Prize Winner
will be disqualified at Sweepstakes Entities’ sole discretion and another
Potential Daily Prize Winner will be selected, if time permits.
SWEEPSTAKES CONDITIONS: This
Sweepstakes is subject to all applicable federal, state and local laws. By entering, Participant (and his/her parent
or legal guardian) agrees to abide by and be
bound by these Official Rules and the decisions of the Sweepstakes Entities on
all matters relating to this Sweepstakes (which are final and binding) and
waive any right to claim ambiguity in the Sweepstakes or these Official Rules. By entering, Participant (and his/her parent
or legal guardian) agrees to release,
discharge, indemnify and hold harmless the Released Parties, their respective
parents, affiliates, subsidiaries and advertising and promotion agencies and
each of their respective officers, directors, employees, representatives and
agents from and against any claims, damages or liability due to any injuries,
theft, damages or losses to any person (including death) or property of any
kind resulting in whole or in part, directly or indirectly, from acceptance,
receipt, possession, misuse or use of the Prize or participation in any
Sweepstakes-related activity or participation in this Sweepstakes. Participant (and his/her parent or legal
guardian) assumes all liability for any injury
or damage caused, or claimed to be caused, by participating in this Sweepstakes
or use or redemption of the Prize. In
the event a Potential Daily Prize Winner or Winner is disqualified for any
reason under the provisions of these Official Rules, such Potential Daily Prize
Winner or Winner and all rights to any Prize will be forfeited in their
entirety and at Sweepstakes Entities’ discretion, a random drawing will be
conducted in order to select an alternate Potential Daily Prize Winner. A Prize or prize notification being returned
as undeliverable will result in disqualification of such Potential Daily Prize
Winner and at Sweepstakes Entities’ discretion an alternate Potential Daily
Prize Winner may be selected.
LIMITATIONS OF LIABILITY: Released Parties are not responsible for any incorrect or inaccurate information, whether caused by
site users, tampering, hacking, or by any equipment or programming associated
with or utilized in the Sweepstakes,
system errors or failures, or faulty transmissions or other telecommunications
or other types of malfunctions or interferences and/or from any hardware or
software failures of any kind, lost, interrupted or unavailable network,
server, Telephone Service Provider (TSP), Internet Service Provider (ISP),
website or other connections, availability
or accessibility or miscommunications or
failed, incomplete or jumbled, scrambled, delayed or garbled or misdirected
computer or telephone transmission, or system errors and failures, or faulty
transmissions, or as a result of any other problems or technical malfunctions or other errors or difficulties of any kind whether human,
mechanical, electronic, computer, network, typographical, printing or otherwise
relating to or in connection with the Sweepstakes, including, without
limitation, errors or difficulties which may occur in connection with the
administration of the Sweepstakes, the processing of Entries, the
announcement of the prizes, the incorrect downloading/uploading of any
Sweepstakes-related materials, injury or damage to any person's computer and/or
wireless related to or resulting from participating in this Sweepstakes or
downloading materials from or use of the TSP or ISP’s website.
If for any reason the Sweepstakes is not capable of running as
planned, including, but not limited to failures to submit an
entry or other disruption related to telephone and/or internet traffic, virus,
bug or any unauthorized intervention whether or not caused by any action(s),
regulation(s), order(s), or request(s) by any governmental or
quasi-governmental entity(ies), equipment failure, including overloading of the
TSP or ISP Website due to excessive use, threatened terrorist act(s), terrorist
act(s), air raid(s), blackout(s), act(s) of public enemy, earthquake(s), war(s)
(declared or undeclared), fire(s), flood(s), epidemic(s), explosion(s),
unusually severe weather, hurricane(s), embargo(s), labor dispute(s) or
strike(s) (whether legal or illegal), labor or material shortage(s),
transportation interruption(s) of any kind, work slow-down(s), civil
disturbance(s), insurrection(s), riot(s), or any other similar or dissimilar
cause(s), (iv) injury or damage to persons or property caused, directly or
indirectly, in whole or in part from any entrant's participation in the
Sweepstakes or by wireless and/or computer virus or otherwise resulting to any
wireless instrument or computer from Participant’s access to the Sweepstakes
via TSP or ISP website or entry into the Sweepstakes, or (v) other errors or
problems of any kind, whether computer, technical, network, printing,
typographical, human or otherwise including without limitation any errors or
problems which may occur in connection with the administration of the
Sweepstakes, the processing of entries, the announcement of the Winner or in
these Official Rules or other Sweepstakes-related materials, Sweepstakes Entities reserve the right at its sole discretion to cancel,
terminate, modify or suspend the Sweepstakes.
In
the event that the operation, security, or administration of the Sweepstakes
is impaired in any way for any reason, including, but not limited to fraud,
virus, or other technical problem, the Sweepstakes
Entities
may, in their sole discretion, either: (a) suspend the Sweepstakes
to address the impairment and then resume the Sweepstakes in a manner
that best conforms to the spirit of these Official Rules; or (b) cancel the Sweepstakes
and at Sweepstakes Entities’ sole discretion, award the Prizes in a random
drawing from among the non-suspect, eligible entries received up to the time of
the impairment.
Sweepstakes
Entities reserve the right and may prohibit at their sole discretion,
disqualify a Participant from the Sweepstakes or winning a prize if, in their
sole discretion, they determine that such Participant is acting in violation of
these Official Rules or in an unsportsmanlike or disruptive manner or
attempting to undermine the legitimate operation of the Sweepstakes by cheating,
hacking, deception, or other unfair playing practices, or intending to annoy,
abuse, threaten or harass any other entrants or Sweepstakes Entities’
representatives.
Participant (and his/her parent or legal guardian) further agrees
that in any cause of action, the Released Parties’ liability will be limited to
the cost of entering and participating in the Sweepstakes, and in no event
shall the Released Parties be liable for attorneys' fees and/or experts' fees
and costs. Entrants waive the right to claim any damages whatsoever, including,
but not limited to, punitive, consequential, direct, or indirect damages.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR
UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF
CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES
ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S
FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING
CRIMINAL PROSECUTION.
USE OF INFORMATION: By entering the Sweepstakes, Participant (and his/her parent or legal guardian) agrees that their entry and any other personally identifiable
information collected or used in connection with the Sweepstakes may be used by
the Sweepstakes Entities.
