Zathura's Red Carpet Adventure Sweepstakes 1. NO PURCHASE NECESSARY TO ENTER OR WIN. Void in Puerto Rico and where prohibited or restricted by law. Sweepstakes is open to legal residents of the 49 continental United States and the District of Columbia (excluding Hawaii), who are of ages 7 to13, as of October 1, 2005. Winners must prove eligibility. Sweepstakes is not open to employees of MTV Networks ("Sponsor") or Sony Pictures Entertainment Inc., and each of their parent, subsidiary and affiliated companies, licensees, advertising and promotional agencies, the independent judging organization, printing agents and any other persons or entities associated with the sweepstakes (collectively, the "Sweepstakes Entities"), or to members of their immediate families (spouses, children, siblings, parents), and/or persons living in the same household as such persons, whether or not related, or to individuals that have won a grand prize in any Nickelodeon Networks-related sweepstakes in the past twelve (12) months. All entries become the property of Sponsor and will not be returned. 2. Sweepstakes commences September 1, 2005, and ends October 1, 2005 (the "Promotional Period"). 3. TO ENTER ONLINE: The Sweepstakes will be posted on www.nick.com starting on or about 12:00pm (noon) Eastern Time ("ET") September 1, 2005, and ending at 12 midnight ET on October 1, 2005. Entrants must fill out all required fields on the Sweepstakes entry form on Nickelodeon's website, www.nick.com, and return the entry electronically. Incomplete or inaccurate online entry forms are void. Any attempted form of participation in the Sweepstakes other than as described herein is void. In the event there is more than one eligible child per household, online entries using parent or legal guardian's email address may be used for each eligible child in the household. For children entering the sweepstakes, by completing the online entry form, a parent or legal guardian is agreeing to be notified by email if you are chosen as a Winner in the Sweepstakes. By entering, you and/or your parent or legal guardian acknowledge compliance with these official rules including all eligibility requirements. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the online portion of the Sweepstakes. Should the online portion of the Sweepstakes be terminated or cancelled prior to the stated expiration date, notice will be posted on the website, and any entries received prior to the termination or cancellation will be included in the drawing. Entries that have been tampered with or altered are void. The use of any automated system or agent to submit entries in connection with this Sweepstakes is prohibited and will result in disqualification. In the event of a dispute over who submitted the winning entry, the holder of the winning first name and email address may be declared the winner at Sponsor's sole discretion and must comply with these Official Rules and may be required to provide proof of ownership of the email account. Collection of personally identifiable information will be in accordance with the Nickelodeon Online Privacy Policy as posted on www.nick.com. OPT OUT: The parent and/or legal guardian of each entrant will be sent a notification e-mail upon electronic submission of the online entry form confirming entry into the Sweepstakes and providing the option to withdraw entry. If the option to withdraw is not exercised within the time period indicated on such notice, the entry will be deemed submitted. 4. The concept of the Sweepstakes is as follows: 5. The prizes are as follows: If a travel guest is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be the winner or an additional travel guest. Winner and guest(s) (if applicable) are solely responsible for providing all necessary identification documents and/or proof of citizenship. Failure to provide such documents may result in trip cancellation upon airport check-in. Prize conditions may be added or modified by companies providing those portions of the prize. The prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit and release (described below) and/or prize travel documents. Total ARV of Grand Prize is $3500. Actual retail value of Grand Prize will be determined by Grand Prize Winner's point of departure. Winner and guests must travel on the same itinerary and depart and return from the same point of origin. First Prize (20): Winners will be awarded a Zathura board game (ARV $30), and a Zathura video console game (ARV $40). Exact prize awarded to be determined by Sponsor. Total ARV of all First Prizes: $1400. Total ARV of all Sweepstakes prizing is $4900. Any depictions of a Prize or Prize element are for illustrative purposes only. 6. Winner Notification and Qualification: Grand Prize Winner (or his /her parent/legal guardian if Grand Prize Winner is a minor) will be required to sign: (a) an affidavit of eligibility and compliance with official rules and any and all legal documents which Sponsor may require (including a W-9 tax form); (b) a release of liability releasing Sponsor and Sweepstakes Entities from any and all liability, claims, demands and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this Sweepstakes or the use or acceptance of the prizes or any portion thereof to be eligible for the Prize; and (c) where permitted by law, a release granting Sponsor the right to use his or her name, voice and likeness for advertising and publicity purposes without additional compensation or notice. Noncompliance within this time period will result in disqualification, and an alternate Grand Prize Winner will be selected. Grand Prize will not be awarded until such requirements are met. In addition, Grand Prize Winner and his/her parent and/or legal guardian and his/her travel companions must sign a travel release prior to ticketing. Upon receipt of the Grand Prize, the Grand Prize Winner and his/her parent and/or legal guardian are required to comply with any and all applicable federal, state and local laws, rules and regulations. The value of the Grand Prize is taxable as income, and Grand Prize Winner's parent or legal guardian is solely responsible for all matters relating to the Grand Prize, including, but not limited to all applicable federal, state and local taxes that become due with respect to the Grand Prize. 7. All prizes are non transferable. Merchandise cannot be returned for cash. Substitution of prizes by winners is prohibited. Sponsor reserves the right in its sole discretion to substitute any prize or prizes with a prize of comparable value. In the event that any Potential Winner chooses not to accept his/her prize, or is unable to be notified, he/she will be disqualified, and an alternate Winner will be randomly selected from all of the remaining entries. 8. By participating in this Sweepstakes, entrants, and where applicable, parents and/or legal guardians, agree to be bound by these rules and the decisions of the judges and Sponsor, which are final in all matters relating to this Sweepstakes. 9. All interpretations of the rules and decisions by Sponsor are final. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or any web site associated therewith; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A SWEEPSTAKES ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS DESIGNEES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH SWEEPSTAKES ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. By registering or opting in to participate in this Sweepstakes, each entrant agrees to waive any rights to claim ambiguity with these Official Rules, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of registration information; acceptance/possession and/or use/misuse of any prize awarded herein (including, but not limited to, cancellations and delays or any change by the air carrier(s), or other company or any other persons providing any of these services for any winner and his/her guests during the trip due to reasons beyond control of Sponsor and/or Sweepstakes Entities); any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; interruption or inability to access the Sweepstakes, any web page associated with the Sweepstakes, or any online service via the internet due to hardware or software compatibility problems; any damage to registrant's (or any third person's) computer and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed/duplicate/multiple data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Registrants further agree to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes, to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize. 10.
