Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN. Sweepstakes
open only to legal residents of the 48 contiguous United
States and the District of Columbia who are between the
ages of 5 and 15 years of age as of the date of entry.
Employees and their immediate families of Sponsors and
those who have won a Grand Prize in any MTV Networks related
sweepstakes in the past twelve (12) months will be considered
ineligible to win. Void where prohibited or restricted
by law.
2. Sweepstakes commences October 1, 2004 and ends October
1, 2005.
Grand Prize Entry Deadlines: All mail-in
entries for the Grand Prize must be postmarked by February
18, 2005 and received by Sponsor not later than February
25, 2005. All online entries for the Grand Prize must
be received not later than 12 Midnight (EST) on February
18, 2005. All “non-winning” entries submitted
for the Grand Prize drawing will be automatically included
in the Secondary Prize drawing.
First and Second Prizing Entry Deadlines:
All mail-in entries for first and second prizes must be
postmarked by October 1, 2005 and received by Sponsor
not later than October 8, 2005. All online entries for
secondary prizing must be received not later than 12 Midnight
(EST) on October 1, 2005.
3. ENTER VIA MAIL: i) Print your complete
name, address, city, state, zip code, daytime phone number
and age on a 3-1/2” x 5” postcard; or ii)
complete an official entry form available on specially
marked packages of following participating Kellogg’s®
cereals: Kellogg’s® Apple Jacks®
11.0 oz. & 15.0 oz., Kellogg’s® Corn
Pops® 10.9 oz. & 15.0 oz., Kellogg’s
Frosted Flakes® 31.0 oz., Kellogg’s
Frosted Krispies® 12.5 oz. and Kellogg’s®
Smorz® 10.5 oz (while supplies last) and mail
one of the above forms of entry in an envelope with sufficient
postage affixed to:

Enter as often as you wish, but each entry must be hand-printed
and mailed in a separate outer stamped envelope. Entries
that are illegible, incomplete, sent via overnight delivery
or telefax, printed by machine or otherwise mechanically
reproduced will not be accepted. All mail-in entries for
Grand Prize winner must be postmarked by February 18,
2005 and received by sponsor not later than February 25,
2005. All mail-in entries for first and second prizes
must be postmarked by October 1, 2005 and received by
sponsor not later than October 8, 2005. All Sponsors and
their agencies are not responsible for entries that may
be lost, late, postage due, delayed, mutilated and/or
misdirected, or for typographical errors in the rules
or entry forms.
4. TO ENTER ONLINE: The sweepstakes will
be posted on www.nick.com starting on 12pm (EST) October
1, 2004 and ending at 12 midnight EST on October 1, 2005.
Entrants must get their parent’s permission and
must fill out all required fields on the Sweepstakes entry
form on Nickelodeon's website, www.nick.com, and return
the entry electronically. Incomplete or inaccurate online
entry forms are void. By entering, participants and their
parents acknowledge compliance with these official rules
including all eligibility requirements. MTV Networks (“MTVN”),
MTVN Online Inc., Viacom International Inc., Kellogg North
America Company, Cayman Islands Department of Tourism,
Hasbro, Inc., THQ, Inc., their parent(s), subsidiaries
and affiliated companies, licensees, advertising and promotional
agencies, the independent judging organization, printing
agents, any other sponsors and any other affiliates or
agents of the Sponsors (collectively the “Sponsors”)
are not responsible for any problems or technical malfunctions,
human error, lost/delayed data transmission, omission,
interruption, deletion, defect, line failures of any telephone
network, computer on-line systems, servers or providers,
computer equipment, software, failure of email or players
on account of technical problems or traffic congestion
on the Internet or at any website or any combination thereof,
including injury or damage to participants or to any other
person’s computer related to or resulting from participating
or downloading materials in this Sweepstakes. If, for
any reason, the online portion of the Sweepstakes is not
capable of running as planned, including infection by
computer virus, bugs, tampering, unauthorized intervention,
fraud, technical failures, or any other cause beyond the
control of the Sponsors which corrupt or affect the administration,
security, fairness, integrity or proper conduct of this
Sweepstakes, Sponsors reserve the right in their sole
discretion to cancel, terminate, modify or suspend the
online portion of the Sweepstakes. Should the online portion
of the Sweepstakes be terminated or cancelled prior to
the stated expiration date, notice will be posted on the
website, and any online entries received prior to the
termination or cancellation will be included in the drawing.
Entries that have been tampered with or altered are void.
The use of any automated system or agent to submit entries
in connection with this Sweepstakes is prohibited and
will result in disqualification. Sponsors reserve the
right to disqualify an individual whom Sponsors determine,
in their sole discretion, is attempting to tamper with
the Sweepstakes or website. In the event of a dispute
over who submitted the winning entry, the holder of the
winning first name and email address will be declared
the winner. Collection of personally identifiable information
will be in accordance with the Nickelodeon Online Privacy
Policy as posted on www.nick.com.
5. The drawing and concept of the Sweepstakes:
Grand Prize: Grand Prize winner will
be selected in a random drawing from mail-in and online
entries on or about February 26, 2005 by an independent
judging organization from among all qualified entries
received by that date.
First and Second Prizes: Winners of first
and second prizes will be selected in a random drawing
of mail-in and online entries on or about October 9, 2005
from the remaining pool of entries.
Limit one prize per household/individual. Odds of winning
will depend on the total number of qualified entries received
at the time of the drawing. The Grand prize winner will
be notified by telephone or by email and/or mail at Sponsors’
discretion within one week following the drawing. All
other winners will be notified by regular mail or email
by January 16, 2006.
6. The parent/guardian of each online entrant will be
sent a notification email upon electronic submission of
the online entry form confirming entry into the sweepstakes
and providing the option to withdraw entry. If the option
to withdraw is not exercised within the time period indicated
on such notice the entry will be deemed submitted.
7. The prizes are as follows:
Grand Prize (1): Grand Prize winner and
five (5) friends (along with three (3) guests each) (for
a total of up to twenty four (24) travelers). Grand Prize
winner and of each of the winner’s guests must be
accompanied by their parent and/or legal guardian. Grand
Prize to include a 5 day/4 night trip (the “Trip”)
to Grand Cayman in the Cayman Islands. Trip to include
(i) round trip coach air transportation for twenty four
(24) from the airport nearest Grand Prize winner’s
residence to Grand Cayman Island (total estimated retail
value $24,000.00); (ii) standard hotel accommodations
of Sponsors’ choice consisting of 6 rooms for 4
nights, quad occupancy (total estimated retail value $5,000.00);
(iii) $10,000.00 spending money for the Grand Prize winner;
and (v) a welcome party for winners and their guests (promotional
value). Dates of travel to be determined by Sponsors once
winner is selected and are subject to change. Grand Prize
package does not include daily transportation
to and from the hotel, gratuities, meals and other incidentals
not specifically stated. Sponsors reserve the right to
add or eliminate elements of the Grand Prize package.
The total estimated retail value of the Grand Prize is
$39,000.00. The parent and/or legal guardian of the Grand
Prize winner will be responsible for all applicable federal,
state and local taxes associated with the Grand Prize
and will be required to complete a W9 for the Grand Prize.
The parent/legal guardian of Grand Prize winner will be
required within five (5) business days of notification
to sign and return affidavits of eligibility and compliance
with official rules and all legal documents which Sponsors
may require. The parent/legal guardian of the Grand Prize
winner and the each of the guests of the Grand Prize winner
will be required to sign and return a liability release
and all legal documents which Sponsors may require. Grand
Prize winner and his/her guests must be able to travel
on dates specified by Sponsors between 4/1/05 and 6/30/05.
Winner and guests must travel together on the same itinerary
and depart and return from the same point of origin. All
travelers must be capable of providing proper travel documentation.
All expenses not specified in the Official Rules are the
sole responsibility of the Grand Prize winner and their
guests. All travel arrangements and accommodations at
discretion of Sponsors.
First Prize (100): The SpongeBob SquarePants
Movie VideoNow Color Collector Player from Hasbro (estimated
retail value $74.99 ea.) Estimated Retail Value of all
first prizes $7,499.00
Second Prize (500): The SpongeBob SquarePants
Movie videogame from THQ (estimated retail value $19.99
ea.) Estimated Retail Value of all second prizes $9,995.00
Total estimated retail value of all prizes: $52,494.00
The date of fulfillment of first and second prizes will
be determined solely by Sponsors at their sole discretion
on or before December 31, 2005.
8. All prizes are non-transferable and have no cash equivalent,
except as indicated herein. All prizes will be considered
taxable income and will be awarded in the name of the
winner’s and/or their guest’s parent or legal
guardian. Merchandise cannot be returned for cash. Substitution
of prizes by winners is prohibited. Sponsors reserve the
right in their sole discretion to substitute any prize
with a prize of comparable value. In the event that any
winner chooses not to accept his/her prize, is unable
to be notified, or can not attend on specified dates set
by Sponsors (Grand Prize winner only), prize will be forfeited
and an alternate winner will be randomly selected from
all of the remaining qualified entries.
9. Winners must prove eligibility. Grand Prize winner’s
parent or legal guardian and his/her guests (and guest’s
parent if the guest is a minor) will be required within
five (5) business days of Grand Prize winner’s notification
to sign: (a) a release (i) relieving Sponsors from any
liability, claims, demands, and cause of action from personal
injury or death, and/or damage, theft, or loss suffered
in connection with this Sweepstakes or the acceptance,
receipt, possession, use and/or misuse of the prizes or
any portion thereof; and (ii) where permitted by law,
granting Sponsors the right to use his/her name, voice,
and likeness for advertising and publicity purposes without
additional compensation; (b) affidavits of eligibility
and compliance with official rules (winner only); and
(c) all legal documents which Sponsors may require (including
a travel release, proper travel identification and W-9
tax form). Entry into Sweepstakes constitutes the Grand
Prize winner’s parent or legal guardian’s
agreement to sign such releases, affidavits and documents.
Failure to timely complete and return the executed documents
will result in forfeiture of the prize and an alternate
winner will be selected from all remaining qualified entries
received. Receipt of any of the prize components of this
Sweepstakes is conditioned upon compliance with any and
all applicable federal, state and local laws, rules, and
regulations. Noncompliance will result in disqualification
of winner and the selection of an alternate winner will
be from all remaining qualified entries received. All
entries become the property of Sponsors and will not be
acknowledged or returned except as indicated herein. If
the Grand Prize winner entered via postcard, he/she will
be notified via phone. If the Grand Prize winner entered
via online, he/she will be notified by email. If the Grand
Prize winner entered online, he/she must respond to the
sender by phone or email within five (5) business days
of Sponsor’s sending of notification or will be
disqualified. All First Prize and Second Prize Winners
who entered via postcard will be notified by mail and
all First and Second Prize Winners who entered online
will be notified by email. First and Second Prize online
winners must respond to the sender by email within two
(2) business days of winner notification or be subject
to disqualification and an alternate winner will be selected.
10.
By participating in this Sweepstakes, entrants agree to
be bound by these rules and the decisions of the judges
and Sponsors, which are final in all matters relating
to this Sweepstakes.
