"All Geared Up" Sweepstakes 1. NO PURCHASE NECESSARY TO ENTER OR WIN. Void in Puerto Rico and where prohibited or restricted by law.Sweepstakes is open to legal residents of the United States who are between the ages 6 and 13 at time of entry. Winners must prove eligibility. Sweepstakes is not open to employees or the immediate family members of individuals employed by MTV Networks, Firefly Mobile, Inc., their parent, subsidiary and affiliated companies, cable affiliates, licensees, advertising and promotional agencies, the independent judging organization, printing agents or any other sponsors (collectively, the "Sponsors"), or those who have won a Grand Prize in any Nickelodeon Networks related sweepstakes in the past twelve (12) months. All entries become the property of Sponsors and will not be returned. 2. Sweepstakes commences August 11, 2005 and ends October 6, 2005 ("Promotional Period"). 3. TO ENTER: Via Mail: Print your complete name, date of birth, address (including city, state and zip code), and daytime phone number on a 3 ½" x 5" postcard and mail your entry to: "All Geared Up!" Sweepstakes Enter as often as you wish, but each entry must be hand-printed and mailed separately. Entries that are illegible, incomplete, sent overnight delivery or via telefax, printed by machine or otherwise mechanically reproduced will not be accepted. Sponsors are not responsible for entries that may be lost, delayed, mutilated and misdirected, or for typographical errors in the rules. All entries must be postmarked by October 6, 2005, and received at the above address by October 20, 2005. Via Online: The Sweepstakes will be posted on www.nick.com during the Promotional Period. Entrants must complete all required data and return the entry electronically. Incomplete or inaccurate online entry forms are void. Use of a profane user name or the submission of false or misleading personal information by an entrant will be grounds for disqualification. Sponsors retain sole discretion to determine whether entry information is profane, false or misleading. In the event there is more than one eligible child per household, online entries using parent or legal guardian's email address may be used for each eligible child in the household. By completing the online entry form, your parent or legal guardian is agreeing to be notified by email if you are chosen as a winner in the Sweepstakes. By entering, you and your parent or legal guardian acknowledge compliance with these official rules including all eligibility requirements. OPT OUT: The parent and/or legal guardian of each entrant will be sent a notification e-mail upon electronic submission of the online entry form confirming entry into the Sweepstakes and providing the option to withdraw entry. If the option to withdraw is not exercised within the time period indicated on such notice, the entry will not be deemed submitted. 4. The concept of the Sweepstakes is as follows: Winners will be selected by Arrowhead Fulfillment in a random drawing from among all eligible entries on or about November 2, 2005. Limit one (1) prize per household/individual. Odds of winning will depend on the total number of qualified entries received. Sponsors will begin notifying winners via email and/or telephone within 2-4 days of the drawing 5. Total ARV of all Sweepstakes prizing: $5,300.96 Sponsors are not responsible for any problems or technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the online portion of the Sweepstakes. Should the online portion of the Sweepstakes be terminated or cancelled prior to the stated expiration date, notice will be posted on the website, and any entries received prior to the termination or cancellation will be included in the drawing. Entries that have been tampered with or altered are void. The use of any automated system or agent to submit entries in connection with this Sweepstakes is prohibited and will result in disqualification. In the event of a dispute over who submitted the winning entry, the holder of the winning first name and email address will be declared the winner. Collection of personally identifiable information will be in accordance with the Nickelodeon Online Privacy Policy as posted on www.nick.com. All email entries must be received at nick.com by 12 midnight EST on October 11, 2005. 6. Winner Notification and Qualification: Potential Winners: Following the drawing, Sponsors will attempt to contact the Potential Winners via phone and/or email. No messages will be left on machines. Each Potential Winner (or their parent or legal guardian if winner is not the age of majority in his/her state of residence ("a minor") must respond to the Sponsors by phone or email within two (2) business days of Sponsors' notification, or will be subject to disqualification. If a Potential Winner (or their parent or legal guardian, if winner is a minor) fails to respond within stated time period, that Potential Winner will be disqualified and an alternate Potential Winner will be selected at random from among all of the remaining eligible entries. In order for Potential Winner to be declared an Official Winner, he/she (or his/her parent or legal guardian if winner is a minor) must prove eligibility to Sponsors' satisfaction within five (5) days of Sponsors sending the legal documents which Sponsors may require (including a W 9 tax form). In addition, Winner (or his/her parent or legal guardian if winner is a minor) will be required to sign an affidavit: (i) releasing Sponsors from any and all liability, claims, demands and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this Sweepstakes, or the use or acceptance of the prizes or any portion thereof to be eligible for the Prize; and (ii) where permitted by law, granting Sponsors the right to use his or her name, voice and likeness for advertising and publicity purposes without additional compensation. In addition, if the prize awarded includes travel, Winner (or their parent or legal guardian if winner is a minor) must sign a travel release prior to ticketing, and will be required to provide a signed affidavit of eligibility and compliance with official rules and any and all legal documents which Sponsors may require (including a W 9 tax form) before being deemed the Official Winner. Noncompliance with the above noted requirements will result in disqualification and the selection of an alternate Winner. Prize will not be awarded until such requirements are met. Upon receipt of the Prize, Official Winner (or their parent or legal guardian if winner is a minor) is required to comply with any and all applicable federal, state and local laws, rules and regulations. The value of the Prize is taxable as income, and the Official Winner (or their parent or legal guardian if winner is a minor) is solely responsible for all matters relating to the Prize, including, but not limited to, all applicable federal, state and local taxes that become due with respect to the Prize. In the event, (i) the Winner chooses not to accept his/her prize, (ii) does not comply with these Official Rules, or (iii) Sponsors are unable to contact such Winner, or notification of Prize is returned as undeliverable, Prize will be forfeited in its entirety and awarded to an alternate Winner randomly selected from all of the remaining entries. 7.
