PARTICIPANT AND SUBMISSION RELEASE
This release is made to allow Nickelodeon and its related and affiliated entities ("Nickelodeon") to include me and/or my child as a participant(s) on Nickelodeon's Online interactive services (the "Service"), and/or tape, photograph, transcribe, "upload" or in any other way use my and/or my child's names, images, likenesses and/or materials including but not limited to my child's art work, photographs, proposals, literary material, video, audio, voices, songs, conversations, sounds, words and/or musical compositions (collectively the "Materials") in connection with the Service, the advertising and promotion of the Service, programming, merchandising and/or programming services throughout the world forever. I recognize that my signature on this release is a condition of (i) Nickelodeon's permitting me and/or my child to be a participant(s) on the Service; and (ii) Nickelodeon's use of the Materials.
Nickelodeon shall have the right but not the obligation to reproduce, exhibit, transmit and distribute and use in any way all of the Materials my child and/or I have sent to you and all materials Nickelodeon creates from the Materials.
By sending you the Materials, I warrant that these Materials were created solely by my child and I have the right to have these Materials sent to you, and give Nickelodeon the right to use the Materials as stated above forever. Furthermore, while I believe my child's Material and its features to be unique and novel, I also recognize that other people may have submitted or will submit to Nickelodeon or Nickelodeon may have created or will create on its own or have created on its behalf, materials that are similar or identical to the material my child and/or I has submitted, and I understand that my child and/or I will not be entitled to any compensation because of Nickelodeon's use of such other similar or identical material or the use of the Material my child has submitted. I also understand that since Nickelodeon hopes to receive a ton of Materials, it cannot be returned to my child and/or me and that not everyone's Materials submitted to you will be used, but if my child's Materials are chosen for display, Nickelodeon may mention my child's first name, age, the city we live in and/or any other biographical facts which my child and/or I have provided to you. I will hold Nickelodeon harmless from and against any claims, damages or expenses (including reasonable attorney's fees) arising out of its use of the Materials. I agree that Nickelodeon shall be the exclusive owner of all rights, including, but not limited to, all copyrights, in and to such Materials, and all derivatives created therefrom, and will be able to use the Materials, in whole or part, throughout the universe, in perpetuity, in all forms and formats now known or hereafter created, and will be able to license others to so use the Materials, in any manner Nickelodeon may determine at its sole discretion. Notwithstanding the forgoing, all personal information provided to Nickelodeon Online will be handled in accordance with the Nickelodeon Online Privacy Policy. I acknowledge that users of the Service may be able to "download" any or all of the Materials in any way without my approval or control and understand that Nickelodeon has no control and/or responsibility for this type of use by third parties. I hereby release Nickelodeon from all liability in connection with any third party use made of such "downloaded" Materials.
I confirm that, to the best of my knowledge, all statements made by me and information provided by my child and/or me in connection with the Service are true.
